Terms of service.

Please read the following conditions carefully before booking. The clauses contained in these conditions and terms form an integral part of your contract with Siramada Tours. Your registration for one of our packages implies your knowledge and acceptance of them, and the clauses contained in this site constitute your contract.

1. Services and flexibility

All services (tours and excursions) included in our packages were confirmed or available at the time of posting on the site. Should any changes occur between now and the date of departure, we will replace the service with a similar one, or it will take place on a different date. No compensation will be paid in return.

The Customer acknowledges, by booking Product(s)/Service(s) and/or agreeing to travel with Siramada Tours, that the nature of this type of travel requires considerable flexibility and acknowledges that he/she will allow reasonable modifications to the Product(s)/Service(s) and/or itinerary by Siramada Tours. The customer understands that the itinerary, schedules, accommodations and mode of transportation may be changed without notice due to circumstances or events which may include illness or mechanical breakdown, incidents at the location where the Product(s)/Service(s) will be operated, flight cancellations, strikes, events emanating from political conflicts, entry or border difficulties, extreme weather conditions and other unforeseeable or unforeseeable circumstances beyond the reasonable control of Siramada Tours.

2. Prices

Prices are based on service providers (accommodation and catering in Senegal), exchange rates, fuel costs, taxes, and other charges that are in force at the time of program preparation. The prices indicated in the brochure/website may increase in the event of an increase in taxes, royalties or fees authorized by a competent public authority. The customer acknowledges that the contract price may be modified in the event of a fuel price increase imposed by the carrier, an increase in port taxes or an increase in the exchange rate, provided that the exchange rate applicable 45 days prior to departure has increased by more than 5% since the date of purchase.

In the event of a price change resulting in a price increase equal to or greater than 7%, excluding the tax of your province of residence, the customer may choose between (1) cancellation of this contract including a full refund, or (2) acceptance of replacement services that may be offered by the travel agent.

However, no price changes can be made within 30 days of departure. All rates shown in this brochure are in Canadian dollars and euros.

Insufficient numbers of participants can be a very valid reason for cancelling trips. If changes need to be made, we will inform you as soon as possible.

3. Deposit and final payment 

The customer expressly acknowledges having read the information on the chosen trip, which was provided prior to invoicing.

For your information, we mention in all our travel programs what is included and what is not included. 

Discover Senegal Tour - 8 days

Deposit: 25% of the total amount. This deposit is non-refundable.

Final payment must be received no later than 30 days prior to departure or according to the date on your invoice, depending on the trip chosen.

The Heart of Senegal Tour - 10 days

Deposit: 35% of the total amount. This deposit is non-refundable.

Final payment must be received no later than 30 days before departure or according to the date shown on your invoice, depending on the trip chosen.

Eastern Senegal Tour - 15 days

Deposit: 45% of the total amount. This deposit is non-refundable.

Final payment must be received no later than 30 days prior to departure or according to the date on your invoice, depending on the tour chosen.

Until the required deposit is received, Siramada Tours has no obligation to confirm reservations and certain promotions may be cancelled.

4. Cancellation or Changes

Any cancellation of your tour must be notified to us in writing only (e-mail). Please note that deposit fees are non-refundable (see section 3).

A cancellation fee based on the amount of the tour chosen will be retained for each person, resulting in the following charges:

  • More than 30 days from customer arrival or tour start date: 30% of the total cost of the trip.

  • From 21 days to 08 days from customer arrival or tour start date: 55% of the total cost of the trip.

  • From 7 days from customer arrival or tour start date: 100% of the total cost of the trip.

These cancellation fees are non-refundable.

Cancellation from Siramada Tours: In the event of cancellation by Siramada Tours other than for reasons of force majeure such as acts of terrorism, political unrest or fear of political unrest, natural disasters, pandemics, government notices, border closures, strikes, etc., the customer will be refunded or credited the total amount paid at the time of cancellation.

At the customer's request, another package may be offered, and the amount previously paid may be transferred to the new choice. Siramada Tours accepts no further liability.

Trip changes: Siramada Tours reserves the right to make changes to any and all aspects of Trips (which may include without limitation changes to the types and/or timing of activities available during the Trips, the hosts, items and/or services included with the Trips, accommodation, the itinerary, and/or the nature of the Trips Classes) if, in Company’s sole discretion, Company deems it necessary to do so due to conditions that may be hazardous, dangerous, or otherwise adverse or threatening, if an act or omission of a third party prevents any such aspects of the Trips or any portion of the Trips, or for any other reason considered commercially necessary by Company. 

5. Refunds for unused services 

No refund will be made for any service not used during the trip.

6. Payments 

Payment by credit card. 

In the case of payment by credit card, you will need to complete an online payment authorization form beforehand.

In the case of payment by bank transfer, you will find our agency's bank details on the invoice that will be given to you when you confirm your trip to make the payments.

7. Late payment

Failure to make a payment within 10 days of the agreed date constitutes a breach of contract and may result in the cancellation of your experience. If you miss several payments, if you have difficulty making a payment, you must send an e-mail to siramadatours@gmail.com to inform the company of a possible delay in payment. Siramada Tours reserves the right to allocate your place to the next eligible client on the waiting list. Any surcharges or additional costs due to late registration for a rebooked trip [that was originally cancelled] will be charged to the traveler.

8. Ground Transportation

Ground transportation is provided in accordance with the various regulations of the organizations managing drivers' hours of operation.

Changes: Consolidations and changes affecting schedules, type of aircraft or vehicle, days of operation, transportation company and itineraries may be affected at any time and without prior notice. We reserve the right to adapt vehicle size to the number of participants. During ground transportation, seats are not reserved, except for the guide's and/or tour leader's seat. They are instructed to rotate seats and demand that there be no exceptions, failing which they will be penalized.

9. Accommodations

Siramada Tours makes every effort to work with service providers who offer quality services. All the accommodation listed on this site is modern and/or traditional, with different classes in different parts of the country. For major reasons, we may change the accommodations listed in the program, but always to a similar or higher category. Rooms are usually composed of one or two double beds, two twin beds or one single bed with private bathroom (unless otherwise stated). You will receive a list of accommodations and their contact details with your documents. Please note that rooms may vary in size and configuration within the same establishment.

10. Room selection

Siramada Cascades acts as an intermediary between you and the various service providers. It is therefore impossible for us to guarantee you a special location, floor or view, as only the hotel and/or camp managers have the privilege of distributing rooms to customers.

11. Luggage

All luggage and travel bags are carried at the traveler's risk and must comply with the airline's instructions if any part of the trip is by air. You will receive luggage tags with your travel documents. Please complete them and attach them to your luggage before departure. Proper identification will facilitate handling (when included only).

We assume no responsibility for loss, theft or damage to your baggage and personal effects. We strongly recommend that you take out baggage insurance. Please note that all passengers are subject to the baggage regulations of the various airlines.

12. Customs and habits

Habits, customs, accommodation, food and living habits in the countries concerned are different from those in your country of origin or residence. You cannot therefore expect to find the same or even similar infrastructure, transport, accommodation, food, customs and habits of life in the countries you visit as in your country of origin or residence. Accommodation and infrastructure classifications are not the same as in your country of origin or residence. Please note that any complaints or claims relating to the habits and customs of the country visited will be automatically refused. 

13. Travel insurance

For peace of mind, we strongly recommend that you take out cancellation insurance for travel within Senegal, and comprehensive package insurance for all travel outside your country of residence. If your trip is insured via your credit card or any other personal insurance, it is your responsibility to check the amounts and number of days covered by your credit card and, if necessary, to take out additional insurance.

The services offered by Siramada Tours as part of its tours do not include a medical emergency service and do not constitute travel insurance for the traveller. Siramada Tours does not provide medical support or services.

14. Documents and customs requirements

It is the customer's sole responsibility to obtain, in a timely manner and at their own expense, any passports, visas, private authorizations or other mandatory travel documents required by government authorities for their trip. These documents may vary according to citizenship status and destination. For some destinations, the passport must be valid for a period exceeding the planned return date to your country of origin or residence. If you fail to provide these documents, the carrier or the competent authorities may refuse you boarding or entry into a country, and you will not be entitled to any refund. Siramada Tours assumes no responsibility for passports, visas, private authorizations or other documents required for entry to or exit from the countries concerned, including the country(ies) where the carrier makes a stopover. It is your sole responsibility to consult and obtain information and documentation specific to your situation from the competent authorities, i.e. embassies, consulates or ministries. You are strongly advised to consult the website or obtain information from the relevant authorities, and to comply with the entry and exit requirements of your destination(s) and any stopover(s). Some countries require proof of vaccination. Please ensure that you comply with the health requirements of your destination(s) and any stopover(s).

A parent traveling alone with a child under the age of 18 may be required to present a written affidavit signed by the other parent authorizing the child to travel.

15. Travel documents for your tour, pre-registration

Approximately 10 days before your departure date, you will receive the program, hotel list and general documentation, provided that full payment has been received. This will facilitate coordination with service providers and suppliers of products on arrival at the various hotels, camps and lodges on the tour.

It is the traveler's sole responsibility to have all necessary and compliant travel documents. Please check carefully all information contained in your travel documents, i.e. airline tickets, vouchers and other documents issued. Please report immediately any errors or discrepancies on the travel documents received. 

Travel documents are non-transferable and are subject to the terms and conditions of the issuer and suppliers of products and services involved in the delivery of services. 

16. Change and/or update of names or rooms

Name change: Please notify us as soon as possible of a name change. Change fees may apply. It is the traveler's responsibility to provide the passport information (first and last name) at the time of booking. 

Room changes: if changes affecting room occupancy are made by one or more customers, prices will be adjusted to reflect actual room occupancy.

 17. Privacy policy

Siramada Tours observes principles of confidentiality regarding personal information transmitted by the customer. For more information on our privacy policy, please visit the dedicated page.

18. Passenger's liability

Any passenger who registers for one of our tours accepts the conditions and policies of Siramada Tours. In the event that a passenger engages in conduct detrimental to other travelers or service providers and, despite a formal warning from one of our representatives, persists in such conduct, the passenger will be automatically expelled from the tour. All expenses and losses incurred as a result of such conduct will not be reimbursed. 

Certain tours and/or activity options offered on some of our programs require particular skill, endurance or technical knowledge (mountain biking, high mountain hiking, etc.). 

Consequently, travelers are responsible for being sufficiently healthy and self-sufficient to undertake their trip, and for carrying sufficient quantities of all necessary medication with them at all times. We reserve the right to question passengers about their physical condition. 

Vaccines: for all questions relating to vaccines and medication, please contact the travel clinic in your country directly.

We accept no responsibility for vaccinations or medication taken in the countries visited.

19. Indemnification

INDEMNITY TO Siramada Tours, hereinafter “THE COMPANY”. You, the customer, shall indemnify the company [Siramada Tours] for failure to disclose any consequential information, such as dietary requests, special meal requirements, allergies or any other special requests. These must be provided at the time of booking and will only be considered on request. The company cannot guarantee that special requests will be met, and accepts no responsibility if they are not. Although every effort is made to forward reasonable requests to the relevant supplier, this does not guarantee that they will be met, as all requests are subject to availability. It is also your responsibility to check and confirm any special requests at the time of booking. In addition, you hereby agree to indemnify and hold harmless the Company Parties from any and all liabilities (including, but not limited to, court costs and attorney's fees) that one or more Company Parties may incur as a result of your participation in the Trips, whether caused by the negligence of a Company Party or otherwise (but excluding any gross negligence or willful misconduct of a Company Party), to the fullest extent permitted by applicable law. 

BINDING EFFECT It is your express intention that this agreement binds your family members and spouse, if you are living, and your heirs, assigns and personal representatives, if you are deceased, and that it be considered a waiver, release and covenant not to sue any party of the company.

20. Exclusion of liability

Siramada Tours acting as tour organizer makes arrangements with transport companies, hotels, camps, lodges and other independent parties in order to provide customers with services. 

Although we choose our service providers with care, we cannot be held responsible for changes to a program in the following cases: airline or shipping delays, flight cancellations, bad weather, political events, entry and exit formalities, or any other incident beyond our control.

In addition, we have no control over them and cannot be held responsible for their acts, omissions, faults or negligence or those of their employees or subcontractors, nor for any loss or damage of any kind whatsoever that may result. The services provided are subject to the terms and conditions of these service providers, and their liability is limited to the terms and conditions of carriage, international conditions and agreements that apply. The terms of this section also apply to employees of Siramada Tours and are limited to purchases made at Siramada Tours.  Siramada Tours assumes no responsibility for any other reservations not made through Siramada Tours.

In the event of force majeure, Siramada Tours reserves the right to cancel, change or modify any part of the tour. Siramada Tours cannot be held responsible and will make every effort to offer equivalent services.

21. Force majeure

A force majeure is an unforeseeable event or cause beyond the control of Siramada Tours such as illness, accident, strike, weather conditions, mechanical breakdown, war, acts of terrorism, demonstrations, political events, pandemics, quarantines, government notices, missed connections and any delays beyond the control of Siramada Tours, etc. 

We STRONGLY recommend that you take out travel insurance to cover your property. Siramada Tours is not responsible for any incidental costs or consequential losses the customer may have incurred as a result of the cancellation of the booking, such as visas, vaccinations, non-refundable flights or trains, parking or other non-refundable charges, loss of income or loss of enjoyment, etc. Customers purchasing products or services are strongly advised to take out comprehensive insurance to cover any type of loss, to the extent that such insurance is available under the laws governing each customer's home country.

Siramada Tours will do its utmost to meet customer expectations and will intervene to assist and propose solutions to its customer, insofar as possible.

Unless previously agreed with the guide, the customer may not modify the tour itinerary.

Any unauthorized modifications will be entirely at the customer's expense, and the customer will not be entitled to reimbursement for any services or accommodation not provided as a result of such modifications.

22. Severability

If any of the terms contained herein shall be unenforceable or void by operation of law or because it is contrary to public policy or for any other reason, such term shall be deemed deleted from these terms or modified accordingly only to the extent necessary to permit all other terms hereof to survive and remain binding. If any provision of these Terms is held to be so broad as to be unenforceable, such provision shall be construed to be only as broad as it is enforceable. The invalidity or unenforceability of any provision of the Terms shall not affect the validity or enforceability of any other provision.

23. Complaints and disputes

 If your tour does not go according to plan, you must first discuss the matter with your local guide, tour leader or destination representative, who will need to ascertain and confirm your dissatisfaction. If the problem cannot be solved on-site and you wish to make a complaint or claim upon your return, you must send it to us within 10 days of your return. After this deadline, any complaints will not be taken into account.

Registration for a tour implies knowledge and acceptance of the general and special conditions and responsibilities described on our website. Any subjective assessment will not be considered.

24. Legislation

As the services are provided in Senegal, any disputes or differences arising from the interpretation or performance of this contract shall be referred to the Dakar Court of First Instance, which has jurisdiction in commercial matters.

25. Activities not included

Siramada Tours disclaims any responsibility for the quality and safety of activities (such as excursions, optional visits, small extras and the like) available in the destination country in which the customer may wish to participate and which are not part of the package, nor for any representations that may be made by the supplier of such activities. Any verbal or written contract concerning such activities is presumed to be between the customer and the supplier in question and is at the customer's risk as to any loss, damage or injury that may occur in connection with the activity. Siramada Tours shall not be liable in any manner whatsoever for any claim or complaint arising from participation in such activities, which are offered by third parties over whom Siramada Tours exercises no control.

26. Photos and marketing

Our customers are informed that our guides and representatives may take photographs of them and/or film them and/or collect their testimonials during the expedition. We reserve the right to use this material for marketing or other purposes without the traveler's permission. If you object to this practice, you must inform us as soon as the tour begins.
